Enterprise bargaining – bargaining order – good faith bargaining – interim decision – s.229 Fair Work Act 2009 – Australian Mines and Metals Association (AMMA), as bargaining agent, made application for bargaining orders against Maritime Union of Australia (MUA) – AMMA sought order that MUA retract, correct and apologise for information it published, and that existing bargaining orders continue to operate – MUA submitted Commission had no power to make bargaining orders unless satisfied good faith bargaining requirements not met, and that in absence of any such findings, Commission could not make order – Commission not of a conclusive view that it would be reasonable in all the circumstances to make orders sought – Commission to examine further parties’ conduct – further conference to be held.
